 釋憲70週年 國際法界人士齊聚探討憲法人權

:

今年恰逢釋憲70週年，蔡英文總統今天(1日)出席「大法官國際學術研討會」時肯定釋憲70週年的成果與功效，並期盼未來司法改革中，憲法法庭能持續穩定台灣民主憲政秩序。司法院長許宗力也表示，司法院已研擬「憲法訴訟法」，期望未來修法後能建構更公開透明，以及提供人權保障的全新憲法審查制度。

為慶祝釋憲70週年，司法院擴大舉辦一年一度的國際學術研討會，並以「憲法法院與人權保障」為探討主題，除了邀請15位大法官與我國學者外，還有美、加、歐洲等重量級法界人士共同與會。

蔡英文總統在開幕致詞中肯定70年來釋憲的成果與功效，並提出未來期許。總統說，隨著釋憲的發展，憲法法庭在每個關鍵時刻，都做出妥適的解釋，也確保了台灣的民主轉型，她希望在司法改革中，憲法法庭持續且全面有效的穩定台灣的民主憲政秩序，保護民眾的憲法權益。總統說：『(原音)我希望，在司法改革中，特別是憲法法庭相關法案可以持續、全面而有效地穩定台灣的民主憲政秩序，保護民眾的憲法權益。』

司法院長許宗力也指出，釋憲制度70週年有兩個重要意義，其一是釋憲制度階段性成果的回顧，其二則是我國憲法審查制度重大變革的新局開啟，而人權保障是跨國界、跨領域的普世價值，世界各民主法治國家的憲法法院，莫不以維護基本人權為其使命天職，而我國大法官也是如此。許宗力說：『(原音)司法具體彰顯我國憲法維護基本人權的核心價值理念，是台灣作為世界自由民主國家一份子的證明。』

許宗力也重申，司法院已研議完成大法官審理案件法的修正草案，將更名為「憲法訴訟法」，同時建立「裁判憲法審查制度」，未來一旦修法通過後，盼能建構一個效能更高、審理程序更加透明，並提供完足人權保障的全新憲法審查制度。

 文大住宿生被犧牲 教團：應2年緩衝

【台灣醒報記者楊蕓台北報導】「選舉是大人們的鬥爭，不應拿學生當犧牲品！」台北市政府日前認定文化大學大群館不能當學生宿舍，直接影響400名學生住宿權益。全教產10日陪同文大師生代表召開記者會，理事長黃耀南表示，大群館解約後，新生宿舍中籤率大幅下降，學生恐要付出高額房租在校外租屋，他呼籲，市政府應給學校2年時間，讓學校、學生有充分時間因應，減少衝擊。

文大宿舍大群館風波鬧得沸沸揚揚，台北市都市發展局日前認定大群館違規做「寄宿住宅」使用，並要求限期2個月改善，衝擊400名住宿生權益。新北市教育產業工會理事長黃耀南無奈的說，在新北市長侯友宜決定與文大解約後，看起來整件事情落幕，但卻是4百名學生安置問題的開始。

「選舉是大人們的鬥爭，學生何辜當祭品！」黃耀南表示，一旦大群館解約，大一新生馬上減少420個床位，「原本學校規劃新生有1714床可抽，現在只剩1294床，預估107學年度新生的中籤率，男生從60%降至38%，」眼看9月即將開學，沒抽中宿舍的學生將要付出更貴房租在校外租屋，文化大學附近本來就一床難求，能否順利找到房子都是問題。

文化大學教師王翔郁指出，依教育部辦法，校外學生宿舍使用、租賃合約4年以上且經法院公證，就可視為校舍，屬教育設施，因此大群館承租完全合乎教育部規定，如今教育部卻改口大群館依市政府的分區使用規定，為違規使用。他認為，「教育部應和市政府討論統一作法，若大群館屬教育設施，自然能當學生宿舍，如果分區使用不得作為宿舍，為何又昱公司之前可以租給學生？」

對於柯文哲打算釋出部分公宅床位供大學生住宿，王翔郁認為，問題在於包括銘傳、陽明、東吳等附近大學的學生都會去爭取抽籤，各校比例如何分配？就算全部的床位都給文化大學，「公宅距離學校將近1小時的交通接駁又該如何處理，」他主張，最好的方案還是讓學生繼續住在大群館，黃耀南也呼籲，柯市長應給予文大至少2年的轉圜空間研擬方案，讓學校、學生有充分的時間因應。
