Step 1: Determine your screen type
Does your device have a raised bezel or a flat front glass screen?

Raised bezel: Screen with a raised frame around the edges.

Flat front glass: Screen with edge-to-edge glass without a raised frame.

 郭冠英勝訴 銓敘部應核准退休定讞

:

前台灣省政府秘書郭冠英申請屆齡退休案，銓敘部退回、保訓會復審駁回後，郭冠英不服打行政訴訟;高等行政法院去年判銓敘部應核准退休，經上訴，最高行政法院今天駁回上訴，郭冠英勝訴定讞。

郭冠英任職前新聞局期間遭監察院彈劾，停職期滿後回任省府，引發屆齡退休可領高額月退爭議，監察委員提案糾正省府，認為任用程序有瑕疵。

銓敘部105年2月決定退回郭冠英的退休案，郭冠英每月約新台幣6萬元的退休金沒了。郭冠英向公務人員保訓會提復審救濟，保訓會指出，郭冠英再任秘書的甄選程序過於草率，違反一般作業時程，銓敘部依法拒絕郭冠英退休申請案，於法有據，因此復審駁回。郭冠英不服，提起行政訴訟，由台北高等行政法院受理。

法院開庭期間，郭冠英主張銓敘部以省府未依公告內容舉行面試，甄選程序欠缺完備性，且無法補正，銓敘部退回他的退休案為違法行政處分。

法院認定，省府未依公告內容舉行面試，銓敘部以此錯誤事實為基礎，退回郭冠英的退休申請，已違法剝奪郭冠英的退休公務員身分，因此判郭冠英勝訴，銓敘部應作成核准退休處分。銓敘部不服提起上訴，最高行政法院今天駁回上訴，全案定讞。

 救國團為附隨組織 56億資產凍結

【台灣醒報記者譚有勝台北報導】黨產會7日認定救國團為國民黨附隨組織，並表示從該組織的人事、業務、財務等跡象都顯示，救國團是國民黨附隨組織，其總值56.1億元的資產將予全面凍結。國民黨團書記長曾銘宗受訪時批評，不當黨產條例早前已被行政法院認定違憲，救國團應對黨產會提行政訴訟，以保障自己的權益。曾任救國團高階主管的人士回應表示，救國團與國民黨並無實質關係，黨產會是「欲加之罪，何患無辭。」

黨產會7日決議認定，中國青年反共救國團（救國團）為國民黨附隨組織。不當黨產處理委員會主委林峯正表示，救國團為國民黨所主導，其第一位主任為前總統蔣經國。

林峯正舉證據說，前總統蔣中正聽取時任救國團主任蔣經國的報告時，曾明確指出，救國團是國防部所屬單位之一，顯見救國團和國民黨關係匪淺，從該組織的人事、業務、財務的跡象都顯示，救國團是國民黨的附隨組織，其總值56.1億元的資產，將予全面凍結，禁止處分。

黨產會調查指出，救國團從1952年成立至今，資產累積已達56.1億元，包括現金等流動資產9.7億元、基金及投資21.7億元、固定資產24.1億元及其他資產0.6億元。

救國團的營業活動及名下不動產遍及全台，依據106年度財報資料，救國團的主要收入有三，分別為青年活動中心共15家，營業收入6.8億元；國民運動中心共13家，營業收入8.8億元；立案補習班共62家，營業收入10.9億元。

經過認定為附隨組織之後，救國團應依黨產條例，需在4個月內向黨產會申報財產；並且其名下財產，原則禁止處分，若有符合該條例所稱之履行法定義務或有其他正當理由，應於處分後3個月內製作清冊報會備查。

救國團企業工會稍早曾前往黨產會陳情，陳情書中指出，救國團的員工並不是黨工，自救國團成立以來便是社會公益服務的組織，成員不分黨派，但黨產會卻持續炒作蔣中正日記及團旗，曲解財務資料，救國團對此表達嚴正抗議。

救國團工會質疑，黨產會為何在尚未調查釐清前，就急欲認定救國團為附隨組織，若一旦凍結救國團資產，今後任何社會公益服務工作的推動都要經過申請，員工依勞基法的規定做服務工作、勞務工作所得的報酬，都要經過黨產會同意才能支領，完全不合理。

曾銘宗受訪時表示，不當黨產條例早前已被行政法院認定違憲，黨產會在法律的基礎上已站不住腳，也不符合法律解讀，因此，在司法院大法官就本案聲請釋憲案作成解釋公布前，應停止訴訟程序。

曾銘宗強調，黨產會近日動作頻頻全是衝著國民黨而來，若救國團被認定為附隨組織，未來恐怕會影響很多青年朋友參與救國團活動的權益，救國團應對黨產會提出行政訴訟，以保障他們的權益。

一位不願具名的前救國團主任受訪時表示，黨產會的認定是欲加之罪，何患無辭。他說，雖然過去救國團是由國民黨所創，且是配合國民黨從事青年運動工作，理事也是由國民黨派來的，國民黨也曾有經費支持救國團的工作。但自從民國80年前總統李登輝主政開始，國民黨便對救國團沒有什麼影響力。

他回顧，自李登輝時代開始，救國團便獨立運作，國民黨沒有指派任務給救國團，也沒有給予經費，如果黨產會以過去威權時期國民黨救國團的關係，追溯至今未免過於牽強。他強調，救國團目前都是適法經營，包括補習班、青年活動都是自力更生，賺取經費，但黨產會全凍結全部資產未免「過分了一點」。

「不當黨產條例過於嚴苛，根本不給救國團活路。」他認為，政府應將不當黨產條例修法，區隔威權時期與獨立運營的資產，對於利用特權得到的資產，救國團可折價賣給國家才是合理的作法，以免影響救國團成員的權益。
